If you are in possession of a residence permit and are subject to a residence regulation and wish to move, this is possible under certain conditions.

If, as a foreign person, you are subject to the residence obligation for a certain place, you can, under certain conditions, have this residence obligation lifted or changed if you wish to move to another federal state. To do this, you must submit a corresponding application to the responsible immigration authority.

The required documents always refer to the particular reason for the request to move. The prerequisites must be proven. The requirements can also be fulfilled by a family member of the applicant. In addition to the documents listed below, the responsible immigration authorities may request further documents from you in individual cases.

• Gainful employment
  • Employment contract or job offer for an employment subject to social insurance contributions with a scope of at least 15 hours, through which at least an income in the amount of the monthly average need according to the Second Book of the Social Security Code for an individual is generated

• Training or study place
• The person in a marriage with you, your registered civil partnership, or the minor child with whom you are related and live or have lived together as a family lives in another place of residence
• Avoidance of hardship (e.g., humanitarian reasons).

• If you would like to apply for the change or cancellation of a residence requirement of your residence permit, you must first submit an application for this to your competent immigration authority.
• Please discuss in advance which documents you need to include with your application.
• The immigration authority will review your application and usually ask the immigration authority of your new place of residence for approval.
• After the review has been completed, you will receive a corresponding decision.

The duration depends on the immigration authority.

Fictitious approval

If the immigration authority of the new place of residence does not respond to the request of the immigration authority of the current place of residence within four weeks, approval is automatically granted and the applicant is allowed to move.

• A move is only possible after your previous immigration authority has given its approval. Therefore, please avoid already moving as long as you have not yet received this approval.
