Zulassung für Pflegeeinrichtungen beantragen

Would you like to set up a nursing service or a nursing home? To do this, you must observe the provisions of the Long-Term Care Insurance Act (PflegeVG = Social Code XI) and apply for approval for your care facility.

Book XI of the Social Code regulates inter alia:

• which companies are allowed to provide care services and
• who finances these services.

A distinction is made between outpatient and inpatient care facilities. Outpatient and inpatient facilities are economically independent facilities:

• Outpatient nursing services are under the professional responsibility of trained nurses. These care for people in need of care in their own or someone else's household. The services  include basic care, housekeeping and care.
• In nursing homes, under the constant responsibility of a trained nurse, people in need of care are cared for, accommodated and cared for on a full or partial inpatient basis.

According to the so-called safeguarding order, the care insurance funds must ensure that the insured are provided with needs-based and uniform care. Therefore, the regional associations of the care insurance funds conclude a supply contract and a remuneration agreement with you as a care facility.

The type and amount of remuneration depends, among other things, on whether you offer outpatient or inpatient services.

Please check with the competent authority which documents you need to submit.

Prerequisites for the approval of an outpatient nursing service are:

• They must be able to guarantee sufficient and uniform nursing care for those in need of care in the long term.
• Their care and domestic care must correspond to the  required quality. This is laid down in the Care Act and in the framework agreements.
• Your nursing service must work economically.
• Your nursing service must be under the constant responsibility of  a trained nurse.
  For recognition as a responsible nurse, the following is a prerequisite:
  • Completion of training as a nurse, health and nurse, health and paediatric nurse, health and paediatric nurse, geriatric nurse, geriatric nurse, state-recognised curative education nurse or state-recognised curative education nurse, insofar as the services of the nursing service are predominantly provided for disabled people in need of care.
  • within the last 8 years at least 2 years full-time exercise of one of the aforementioned professions
  • As the owner of a nursing service, you can also be a responsible nurse yourself if you meet the requirements.
• You must ensure that the responsible nurse is represented by an appropriate nurse in the event of absence (e.g. illness, vacation). In addition, your nursing service should employ other suitable employees. These include, for example:
  • state-approved family carers
  • Geriatric Care Assistants
  • Nursing assistants
  • Home and family care assistants
  • Housekeepers
• The safeguarding order of the care insurance funds determines further requirements for the organisation and tasks of your care service. These include:
  • Organization:
    • Your nursing service must ensure the care of a changing circle of people in need of care in your area of operation.
    • Depending on your individual care needs, you must be able to provide care services day and night, including Sundays and public holidays.
    • Your nursing service must have its own business premises and be reachable at all times. As a rule, private apartments are not suitable for setting up a nursing service.
    • You must employ a care team of at least 4 employees.
    • In addition, you must prove sufficient business liability insurance.
  • Service offer:
    You must submit your service offer in writing to the contract departments of the nursing care insurance funds for coordination and approval. You should provide the nursing care fund with the following information:
    • Your range of services
    • the manner in which services are provided
    • Your care concept
    • the staffing of your nursing service
    • the availability or accessibility of your nursing service
    • Nature and form of cooperation with other services
    • Your performance of advisory functions
    • Your participation in quality assurance measures

Requirements for admission as a nursing home are:

The admission requirements and the procedure for nursing homes essentially correspond to those for outpatient care services. The competent authority for the approval as a nursing home and for the conclusion of a supply contract according to the Social Security Code XI are the regional associations of the nursing care funds.

However, the Hessian Act on Care and Care Services (HGBP) results in additional provisions. These relate, for example, to operational requirements, personnel requirements and the participation of residents.

Nursing homes must be notified to the responsible office for care and at least 3 months before the planned commissioning.

For the approval of your nursing service, please contact the regional associations of the nursing care funds. According to Book XI of the Social Code, the care insurance funds may only provide care through care facilities with which a supply contract exists.  If your nursing service meets the requirements, the regional associations of the care insurance funds  conclude a supply contract with you.

Irrespective of the application for authorisation to the regional associations of the care insurance funds, you must register your business with the municipality of your future business premises.
