The purpose of the Closed Substance Cycle Waste Management Act (KrWG) is to conserve natural resources and ensure the environmentally sound disposal of waste. Ecologically and economically optimized management of resources (including waste) is characterized by resource-saving production methods and processes for the avoidance and recycling of waste. Measurements and investigations are necessary to ensure compliance with these requirements.
Certain measurements and tests in accordance with the
- Sewage Sludge Ordinance (AbfKlärV),
- Waste Oil Ordinance (AltölV),
- Biowaste Ordinance (BioAbfV),
- Waste Wood Ordinance (AltholzV) and
- Landfill Ordinance (DepV)
may only be carried out by experts or inspection bodies that have been designated (i.e. notified) by the competent authority.
The "Fachmodul Abfall" of the Bund/Länderarbeitsgemeinschaft Abfall (LAGA) regulates the requirements for the competence and notification of inspection bodies (measuring and testing bodies) within the framework of the KrWG and the previously mentioned ordinances issued in this context. The following requirements are described for the technical competence of the inspection bodies:
- Staffing - Guarantee of technical equipment requirements
- Internal and external analytical quality assurance via quality management
- Ensuring the quality and quantity of the tests in accordance with the parameters and classification values of the statutory regulations
- Employment of samplers with professional qualifications
The applicant must submit the following application documents, among others:
- Curriculum vitae, certificates of professional training, evidence of the previous professional activities of the laboratory manager and his/her deputy
- Information on the number and qualifications of employees
- Information on technical equipment
- Information on whether the testing laboratory is recognized in other countries (proof of accreditation or approval certificates from licensing authorities in other countries)
- Proof of successful participation in interlaboratory comparisons
Existing accreditations in accordance with DIN EN ISO/EC 17025 are taken into account as proof of competence, provided they are valid, applicable and complete for the testing task applied for.
An administrative fee of between EUR 60.00 and EUR 1,500.00 is payable for the designation of the inspection bodies (notification), depending on the administrative effort involved.
