If, as a foreign national, you are subject to the employment requirement for a certain type of employment or a certain employer, you can have this employment requirement changed if you move to another company under certain conditions. To do this, you must submit a corresponding application to the relevant immigration authority. In most cases, the outcome is dependent on the approval of the Federal Employment Agency involved in the decision.

The required documents always relate to the respective change of employer. The requirements must be proven.

Foreign person subject to an employment requirement with a residence permit for employment

• Gainful employment

• Study or training place
  • Training contract
  • Confirmation from the person providing the work that the training position has been taken up
  • Certificate of study
  • Integration courses
  • Vocational language courses
  • Qualification measures
  • Further training measures
• Place of residence in the area of responsibility of the immigration authority
  • Registration certificate or rental agreement and landlord's declaration of moving in

Foreign person who is subject to an employment requirement

• An income that secures their livelihood
• Training or study place or employment contract (draft is sufficient)
• Main residence in the area of responsibility of the immigration authority
• Completion of training or studies recognized in Germany

• If you would like to apply for a change of employment on your residence permit, you must first submit an application to your local immigration authority. Send a copy of your current residence permit with your application and describe which condition you would like to change and how.
• The immigration authorities will then tell you which documents they need from you.
• Then submit the required documents in full to your immigration authority.
• The immigration authority will then check your application and usually ask the Federal Employment Agency for approval.
• Once the examination has been completed, you will either receive an appointment, a new residence permit by post or a notification of rejection.
