You are the owner or operator of public telecommunications networks or telecommunications lines serving public purposes and wish to lay or modify telecommunications lines in public roads. To do so, you require the written or electronic consent of the carrier of the easement. The prerequisite for this is the submission of an application in written or electronic form before the construction work is carried out.
The application must contain information on the specific location of the pipe laying, in particular which road and which road components are affected, stating the network node and kilometer, as well as information on the type and depth of laying.
If a complete application has been submitted and the road construction authority agrees to the relocation or modification after reviewing the application documents, it will issue its approval by means of a notice in accordance with Section 127 (1) of the Telecommunications Act (TKG).
The applicant is obliged to bear the administrative costs.
Under certain conditions, approval is deemed to have been granted after a period of three months following receipt of the complete application. In the case of only minor construction measures that are reported in full to the carrier of the road construction obligation, approval is deemed to have been granted if the carrier of the road construction obligation does not request that a corresponding application be submitted within one month.

The applicant must be the owner or operator of a public telecommunications network or a telecommunications line serving public purposes. The structural implementation for the laying or modification of the telecommunications line takes place in a public road.
As the owner or operator of public telecommunications networks or telecommunications lines serving public purposes, you apply for approval to lay cables in the public road, submitting complete application documents. The public highway authority examines the application and, if necessary, grants approval subject to conditions and instructions by means of a decision in accordance with the Telecommunications Act (TKG).
Under certain circumstances, an on-site meeting is required before the decision is issued.
Under certain circumstances, fictitious approval may also apply, i.e. approval is deemed to have been granted after a period of 3 months. The applicant is obliged to bear the administrative costs.
If application documents are subsequently submitted or amended, the deadlines for processing by the infrastructure manager and, in particular, the deadlines for fictitious approval begin anew.
An objection may be lodged against the decision within one month of notification.
The objection can be submitted in writing, in writing or electronically with a qualified electronic signature.
