Ausnahmen vom Vermarktungsverbot beantragen

The animal and plant species listed in Annexes A and B to Regulation (EC) No 338/97 shall be subject to a general prohibition on marketing. This EC regulation implements the Washington Convention on International Trade in Endangered Species of Wild Fauna and Flora in the European Community. Consequently, all national provisions relating to marketing do not apply to these species. The EC marketing ban comprises:

• Purchase
• Offer to buy,
• acquisition for commercial purposes,
• display for commercial purposes,
• use for commercial purposes, and
• Sale
• stockpiling for sales purposes,
• Offer for sale or
• Transport for sales purposes.

An exemption from the prohibition may be granted on application in individual cases.

Documents are required that are suitable for proving that the respective specimen

• lawfully bred (e.g. herd-book, inventory, officially certified herd declaration),
• lawfully acquired within the EC (e.g. delivery note, invoice, purchase contract, important: only applies in connection with proof of possession by the first owner)
• lawfully taken from nature within the EC (exemption) or
• legally imported into the EC (import permit)

The application must be submitted in good time before the intended marketing activity.

The original EC certificate must be sent to the purchaser for each marketing activity.

An objection to the decision may be lodged within one month in writing or for transcription with the authority.

In the case of import into the EC, please contact the Federal Agency for Nature Conservation (BfN).
