Approval of private inspection bodies under the Foodstuffs Act (LSpG) and the Trademark Act (MarkenG)
The activity as an inspection body under Regulation (EU) No. 1151/2012 of the European Parliament and of the Council of 21.11.2012 on quality schemes for agricultural products and foodstuffs requires approval. This must be applied for.
After receipt of the application, the inspection bodies receive special documents to prove their qualification according to the regulation of the Saxon State Ministry for Energy, Climate Protection, Environment and Agriculture (SMEKUL) of November 27, 2000, which contains the requirements and the procedure for the approval of private inspection bodies according to the Food Specialities Act and the Trademark Act.
The approved inspection bodies are published on the websites of the Saxon Ministry for the Environment and Agriculture and the State Office for the Environment, Agriculture and Geology (LfULG).
Single Point of Contact
For this procedure, you can use the service of the Single Point of Contact (Einheitlicher Ansprechpartner). They will guide you through the administrative procedure, take care of correspondence with all the offices responsible for your request and will be available to you as a competent advisor.
The following may be appointed as a private inspection body
- meets the requirements for certification programs and systems for accreditation according to DIN EN 45 011/ ISO/ IEC Guide 65,
- meets the requirements specified in Article 39 of Regulation (EC) No. 1151/2012 and
- has a place of business within a Member State of the European Union or another State party to the Agreement on the European Economic
- has the expertise, equipment and infrastructure necessary to perform the tasks assigned to it,
- has a sufficient number of appropriately qualified and experienced employees, and
- is independent and free of any conflict of interest with regard to the performance of the tasks assigned to it.

- You must apply for recognition as an inspection body in writing.
- After receiving the application, the applicant inspection body receives the necessary forms to prove its qualifications (documents vary depending on the applicant).
- Fill out the forms as indicated and send them along with all other required documents to the responsible office.
- The responsible department will check your application and will contact you if further information / clarification is required.
