Every EU citizen has a right to free movement within the European Union. The same applies, under certain conditions, to family members of EU citizens, regardless of whether they are EU citizens themselves.

Every EU citizen has a right to free movement within the European Union. The same applies, under certain conditions, to family members of EU citizens, regardless of whether they are EU citizens themselves.

Free movement means the right to move freely within the European Union, to enter and reside in any other Member State and to engage in economic activity under the same conditions as nationals.

The Act on the General Freedom of Movement of EU Citizens (Freedom of Movement Act / EU)/(Freizügigkeitsgesetz/EU) regulates the entry and residence of nationals of other Member States of the European Union and their family members.

Family members are:

  • the spouse, the life partner as well as the relatives in the descending line of the EU citizens entitled to freedom of movement or their spouses or life partners who have not yet reached the age of 21, and
  • the relatives in the ascending and descending line of the EU citizens entitled to freedom of movement or their spouses who are dependent on them.

Attention If you are staying in Germany to study, only your spouse or life partner and your children who are granted maintenance can invoke the right of free movement.

Erforderliche Unterlagen

  • Identity card or passport
  • for employees additionally:
    • Employment contract or confirmation of employment or employment contract or confirmation of employment of spouse or partner
  • for self-employed persons additionally:
    • Trade licence or proof of self-employment or trade licence or proof of self-employment of the spouse or partner
  • Civil status documents (e.g. marriage certificate, birth certificate)
  • in addition, for persons who are not gainfully employed
    • Proof of sufficient health insurance cover and sufficient means of subsistence
  • for students additionally:
    • Certificate of enrolment
  • biometric photo

Voraussetzungen

If you yourself are an EU citizen or a citizen of the European Economic Area (Norway, Iceland and Liechtenstein) or Switzerland as a family member, you have a right to freedom of movement if certain conditions are met.

  • A certificate as proof of your right to freedom of movement as a family member is not required. This does not apply to family members of Swiss nationals who apply for a residence permit - CH as proof of their right of residence.
  • If you come as a family member neither from an EU member state nor from an EEA state or Switzerland, but from another state (so-called third country), then you are entitled to a derived right of residence.

Note: Family members entitled to freedom of movement who are not EU citizens are issued a residence card ex officio.

Administration fees:

  • EUR 28.80
  • for persons who are not yet 24 years old: EUR 22.80

Verfahrensablauf

To obtain the residence permit, you should report to the competent office in person or in writing.

  • If all the necessary requirements are met, you will be issued a residence card within six months, which is valid for five years. You have to collect this in person.
