Students whose educational, developmental or learning opportunities are impaired to such an extent that they have special educational needs are entitled to special educational support on the basis of the Saxon School Act and the School Regulations for Special Needs Schools.
Whether a student has special educational needs is determined within the framework of a procedure initiated by the State Office for Schools and Education.
The application for the determination of special educational needs can be submitted by the parents or the school. In case of children starting school, the elementary school at which the child was enrolled assumes this task. The application is submitted to the responsible subsidiary of the State Office for Schools and Education.
The school supervisory authority commissions the Mobile Special Education Service of the relevant special needs school to conduct this procedure.
Note: Before initiating the procedure, the school or the parents request a consultation with the Mobile Special Education Service.
- After the State Office for Schools and Education has initiated the procedure and commissioned the Mobile Special Education Service of a special needs school to determine the special educational needs, the service contacts the parents and the reporting school.
- In order to experience the child/student in his/her familiar environment, the teacher entrusted with determining special educational needs visits him/her at his/her place of learning. He/she observes the child playing and the student learning and interacting with other children or students. Fears, concerns and reservations are addressed in talks with the parents. The student can participate in the lessons of the special needs school on a trial basis.
Determination of the need for support
After the procedure has been completed, the responsible subsidiary of the State Office for Schools and Education will issue a decision based on a special educational needs report, in which statements are made about the special focus and the special educational needs. In addition, taking into account the parents' wishes, recommendations are made regarding the special educational needs program and the appropriate place of learning.
- On the basis of the report, in particular the suggestions for support contained therein, the responsible subsidiary of the State Office for Schools and Education determines the special educational support needs of the student.
- They advise the parents on which form of special educational support is suitable and in which (type of) school the student’s individual special educational support needs can best be met. This can be through inclusive instruction in a general education school or admission to a special needs school.
Note: The procedure can be initiated at any time. However, in order to provide the best possible support for the students concerned and for organizational reasons, it is recommended that the notifications are completed by the end of November or the end of January of the current school year.
