Pupils whose educational, developmental or learning opportunities are impaired to such an extent that there are indications that they require special educational support are entitled to special educational support in accordance with the Saxon School Act. This special educational support is a special, specialised and in-depth form of individual support. It is available to pupils who require specific support in order to be able to learn successfully.
The first step is to decide "whether" special educational support should be provided. Then a decision must be made on the "how" and "where".
Each pupil should be given the best learning environment for them.

The following documents must be submitted for enrolment at a special school:
- notification from the State Office for Schools and Education stating that the pupil has special educational needs
- if the child has not yet attended school, the birth certificate or corresponding proof of the child's identity must be presented at the time of enrolment
The following data is also collected:
- surname and first name of the parents and the child
- date and place of birth of the child
- gender of the child
- address of the parents and the child
- telephone number, emergency address
- nationality of the child (with the parents' consent)
- religious affiliation of the child
- type and degree of disability and chronic illnesses, insofar as they are relevant to school attendance (with parental consent)
- information as to whether a day care centre will be attended in the year prior to school admission
- declaration of custody; in the case of sole custody of one parent, this must be proven
- declaration by the parents that the child is bilingual or multilingual if the language of origin is not or not exclusively German (with the parents' consent).

Before applying for the procedure to determine special educational needs
- the primary school as part of the admission procedure,
- after the start of compulsory schooling, the school that the pupil attends
- or the parents
apply for counselling by the Mobile Special Education Service (MSD) of the special school.
The application must be submitted directly to the MSD in whose area of responsibility the primary school or previous school is located.
The MSD can observe the child at the day care centre or the pupil at the school they attend. In addition, the MSD can consult with the educational staff at the day-care centre, class teachers and subject teachers about their findings and perceptions and give advice on support measures.
The parents must be informed about the counselling and the intended measures.
The State Office for Schools and Education then initiates the procedure for determining special educational needs by appointing an MSD to determine the special educational needs.
The MSD informs the parents of the intended procedure. With the parents' consent, existing reports should be included.
The MSD concludes the assessment of special educational needs with a report. The report contains statements
- which special educational needs exist in which special educational focus(s),
- which further educational programme is recommended and
- whether inclusive education is possible.
The MSD makes appropriate support proposals.
The State Office for Schools and Education determines the pupil's special educational needs on the basis of the special educational needs report, in particular the support proposals it contains. The State Office for Schools and Education advises parents, among other things, on which type of school and at which school the pupil's special educational needs can best be met. It can recommend a school.
With the decision, parents can enrol their child at the special school or, if inclusive education is recommended, at the appropriate mainstream school. Enrolment can also take place at a corresponding approved alternative school.
The headteacher will decide whether to admit the pupil to the school, depending on the number of places available.
