Obligation to notify and transmit information on substances that are not desirable from a health point of view (Notification and Transmission Ordinance - MitÜbermitV)

Food and feed business operators are obliged to notify the competent authorities of the results of tests they have carried out on dioxins, dioxin-like and non-dioxin-like polychlorinated biphenyls. Dioxins and polychlorinated biphenyls are highly toxic chemical compounds. They are mainly ingested through animal food and can be dangerous even in low concentrations.

Notification is not only required in the case of maximum levels being exceeded, but also for all test results of the substances listed in § 1 of the Notification and Transmission Ordinance.

The following substances must be reported to the competent authorities:

• congeners (chemical compounds) of dibenzo-p-dioxins and dibenzofurans and congeners No. 1 - 17 according to Annex 1 MitÜbermitV
• congeners of dioxin-like polychlorinated biphenyls and the congeners under Nos. 1 - 12 in accordance with Annex 2 to the Mit-MitV
• congeners of non-dioxin-like polychlorinated biphenyls and the congeners under Nos. 1 - 6 in accordance with Annex 3 to the Mit-MitV

If the examination has been carried out with an examination method with which the congeners mentioned cannot be determined, the obligation to notify shall only apply to dibenzo-p-dioxins, dibenzofurans and dioxin-like polychlorinated biphenyls as a group of substances.

• The notification must be in electronic form and contain all data pursuant to Annex 4 of the MitÜbermitV.
• Electronic templates in Excel format are to be used for the notifications. The electronic templates to be used according to the MitÜbermitV are provided by the competent authorities of the Laender (see competent authority) or linked to the website of the Federal Office of Consumer Protection and Food Safety (BVL). There you will find a sample of such a digital registration file for both food and feed to make your work easier.
• The format must not be changed.
• In the food sector, please follow the instructions of the competent food monitoring and veterinary office.
• For the notifications of feed business operators, follow the link on the website of the Saxony State Investigation Authority in the section "Official feed monitoring".
• These data are transmitted anonymously by the competent authorities to the Federal Office of Consumer Protection and Food Safety (BVL).
• From this data, the BVL prepares its quarterly report on the content of undesirable substances in or on food or feed.

Important: If it is not possible to process Excel documents for software-related reasons, you can agree on a different, preferably Excel-compatible format for data exchange with the responsible Food Monitoring and Veterinary Office/Feedstuffs Division of the Saxony State Investigation Agency.

• The notification must be submitted within 14 days after the entrepreneur has knowledge of the investigation result.

Note: This is only the case when the test result has been finally determined.

• The notification must be submitted immediately if a maximum content has been exceeded which is laid down in the German Food and Feed Code (Lebensmittel- und Futtermittelgesetzbuch, LFGB), in an ordinance issued on the basis of the LFGB or in a directly applicable legal act of the European Community or the European Union.
