If you want to practice your profession as a lawyer together with other professionals, you can join together to form a professional practice company.

Note: This also applies if only one person is a partner.

There may be an obligation to obtain a licence. You can choose the legal form of the professional practice company. Admissible are, among others, companies under German law, including commercial companies, and European companies. After successful admission as a professional practice company, you will receive a certificate of admission and a confirmation of admission.

For this procedure, you can use the service of the point of single contact. They will guide you through the procedure, take care of correspondence with all the offices responsible for your request, and will be available to you as a competent advisor.

• The object of the company is to advise and represent clients in legal matters and to practise the legal profession.
• The partners are lawyers, tax advisors, tax agents, auditors or members of the legal profession, tax advisors, auditors and sworn accountants of certain other professions.
  
  • Members of the legal profession, tax consultants, auditors and sworn accountants of certain other countries;
  • Persons practising a liberal profession.
• Shares in the professional practice company may not be held for third parties.
• Third parties may not participate in the profits of the professional practice company.
• The company's management body must include a number of lawyers authorised to represent the company.
• The professional practice company must have adequate professional indemnity insurance.

Procedural costs:

• Basic fee for max. 3 shareholders: EUR 1,000
• Additional fee for each additional person as shareholder or member of the management and supervisory bodies: EUR 150.00

You can submit the application using the application form, which you can obtain from the website of the Bar Association, or online via Amt24. Submit the completed application form and the required attachments with all necessary documents to the Bar Association.

Online Application

Set up a service account in Amt24 for identification and authentication and use it to log in to the service portal. Have the required documents ready.

• Follow the link to the online application and complete the data fields according to the instructions. You can save the information at any time and complete it at a later date.
• Once all data fields have been filled in and the listed documents have been compiled, complete the application and the data will be sent to the responsible department.
• You will find the application confirmation in the inbox of your service account. You will receive a notification of incoming messages to your personal e-mail address.

Examination and Authorisation

• The Bar Association checks the admission requirements.
• If the admission requirements are met, the professional practice is admitted and receives an admission certificate.
• Upon authorisation, the professional practice company becomes a member of the Bar Association and receives its own special lawyer's mailbox (besonderes Anwaltspostfach, beA).
• An appeal against the decision of the Bar Association can be lodged with the Saxon Bar Court.
