Notification according to § 3 Versteigererverordnung (VerstV)
You need a permit for the commercial auction of third-party movable property, third-party real estate or third-party rights. Each individual auction must be reported to the competent authority and the Chamber of Industry and Commerce (IHK) in whose district the auction is to take place.
Tip: In case of auction of agricultural inventory, agricultural and forestry products or livestock, no notification is required.
Single Point of Contact (Einheitlicher Ansprechpartner)
For this procedure, you can use the service of the Single Point of Contact (Einheitlicher Ansprechpartner). They will guide you through the administrative procedure, take care of correspondence with all the offices responsible for your request and will be available to you as a competent advisor.
As a rule, the following documents are required:
- Permission for auctions according to § 34b GewO
- certificate of receipt according to § 15 Abs. 2 Gew
- Opossibly auction order
In some cases, further documents or evidence (such as that the auctioned goods are used goods) may be required.
- Notify the competent body in writing of the auction or electronically least two weeks before the date of the auction.
- Ask the responsible office whether a form is available. Depending on what the authority offers, you can also access the form in electronic form in Amt24 ("Forms & online services").
- With the notification you must notify the competent body
- Place and time of the auction
- Type of goods to be auctioned
- in the case of exceptions to the ban on auctions:
- Occasion of the auction (estate or insolvency estate, business closure, public auction)
- Name and address of the principals
- Possibly further information (e.g. storage location of the auctioned goods, inspection times)
- The competent body shall examine the notice of auction and, if necessary, obtain an opinion from the Chamber of Industry and Commerce (IHK). This can be done up to the third day before the auction.
- If there are no objections, the auction can take place.
- A written document (confirmation of receipt of the notification) is not issued.
Notification of the auction: no later than two weeks before the auction date
Note: In exceptional cases, especially in the case of perishable auction goods, you can request a reduction of this period.
With the auction notice, you can also request a reduction of the deadline or the admission of an exception:
- Shortening of the notification period of at least two weeks before the auction date, especially in the case of perishable auctioned goods
- Exemption from the obligation to have the auctioned goods inspected for at least two hours (if you give the bidders sufficient opportunity to assess the auctioned goods in another way)
- The prohibition on auctioning goods offered for sale in open sales outlets and which are unused or whose intended use consists in their consumption shall not apply if the goods to be auctioned are
- belongs to an estate or insolvency estate,
- is sold due to the discontinuation of the business or
- sold by public auction.
Wenn Sie mit der Versteigerungsanzeige auch eine Fristverkürzung beziehungsweise die Zulassung einer Ausnahme beantragen, fallen jeweils Gebühren an, die sich nach dem Verwaltungsaufwand richten.
