Notification of changes to installations requiring immission control approval pursuant to Section 15 of the Federal Immission Control Act (BUNDESIMMISSIONSSCHUTZGESETZ, BImSchG)

The competent authority must be notified of any change in the location, condition or operation of an installation requiring a permit under immission control law at least one month before the change is to be started if no permit is applied for.

You must also notify the competent authority if you, as the operator, intend to discontinue the operation of an installation requiring a permit.

• The competent authority confirms receipt of the notification and informs you which additional documents it requires for assessment.
• The competent authority shall examine within one month at the latest whether the change requires a permit pursuant to Article 16 Bundesimmissionsschutzgesetz.
• As the project owner, you may carry out the change as soon as the competent authority informs you that you do not require an official permit.
• If you do not receive a response from the competent authority within one month (after submitting all the required documents), you may carry out the change in the same way.

The competent authority shall assess within one month after submission of all required documents whether the modification of the installation requires a permit.
