Granting of assistance for subsistence according to § 27a of the Federal Supply Act (BVG)
Assistance for subsistence is given to people whose economic (and socio-cultural) existence cannot be secured in any other way. Necessary subsistence includes food, clothing, household goods, personal hygiene and the personal needs of daily life, such as expenses for telephone, magazines or visits to concerts.
The social assistance agency grants the benefit as a lump sum, the so-called standard need. In addition, reasonable costs for accommodation and heating are covered, as well as contributions to health and long-term care insurance if required and, under certain circumstances, pension insurance contributions.
For children and young people attending a general or vocational school, the social welfare office recognises (on application) benefits for education and participation in social/cultural life ("education package"). In contrast to the other assistance, you must apply for these benefits.
Supplements for additional needs
In addition to the above-mentioned benefits, those affected are entitled to supplements for additional needs, especially if they are
- are pregnant
- are a single parent
- have an illness that requires special nutrition
or - have the "G" mark (walking disability) and have either
- have reached the age limit (depending on the individual case 65 years and older) or
- have not yet reached the age limit, but are fully incapacitated for work.
One-off benefits
In addition to the regular benefits, the Social Welfare Office also grants one-off allowances for
- the initial furnishing of the home, including household appliances,
- initial equipment for clothing and initial equipment for pregnancy and childbirth, and
- the purchase and repair of orthopaedic shoes, repair of therapeutic appliances and equipment, rental of therapeutic appliances.
In addition, the social welfare office can also cover rent debts and funeral costs.
Note: Funeral costs are not part of assistance for subsistence, they fall under assistance in other life situations.
Determining entitlement to benefits
When calculating who is entitled to benefits, the Social Welfare Office must in principle take into account all the income of the person concerned. Excluded from this are in particular
- Basic pensions under the Federal Pensions Act
- Pensions and allowances under the Federal Compensation Act, in each case up to the amount of the basic pension under the Federal Pension Act
- Allowances from voluntary welfare associations (provided that social assistance is justified in addition), and
- private benefits granted by third parties without legal or moral obligation, insofar as their consideration would mean particular hardship for the recipient
Parental allowance is also taken into account. However, a special rule applies to those entitled to parental allowance who were gainfully employed before the birth of their child. State parental allowance is not taken into account.
In order to calculate the claim, proof of costs, income and assets are required in particular. Please contact the KSV individually to find out which documents are required in detail.
Affected persons are entitled to assistance with living expenses within the framework of social assistance (or war victims' welfare) if
- they have their usual place of residence in Germany and
- if they are unable to cover their living costs entirely or at all from their own resources - in particular from their own income and assets or with the help of others (e.g. relatives).
If the persons concerned live in a home, the Social Welfare Office assumes the full or partial costs of the home within the framework of assistance for living and pays an appropriate cash amount (pocket money).
Social assistance benefits according to SGB XII
- No application is required for this. Rather, it is sufficient that the social welfare agency - in this case the Saxony Municipal Social Welfare Association (KSV) - becomes aware of the neediness, either through the persons concerned themselves or through others. (Exception: education and participation package)
Proof of entitlement, counselling and further assistance
- To establish a claim to social assistance, the necessary evidence must be submitted. The staff of the Saxony Municipal Social Welfare Association (KSV) provide comprehensive advice to those affected and their relatives on this and also check whether other special support services are useful, such as those offered by the debt counselling centres.
Broadcasting fee
If you receive certain state social benefits such as assistance for living expenses, you can apply to be exempted from the broadcasting contribution.
