Recognition and Disclosure as an Expert Pursuant to Section 18 of the Bundesbodenschutzgesetz (BBodSchG)

The Bundes-Bodenschutzgesetz (BBodSchG) provides for the involvement of experts in several departments. In order to be recognised as an expert in this field, you must have the necessary expertise and technical equipment, as well as being suitable for this activity due to your reliability and personal integrity.

Recognised experts are recognised and active in six different fields:

  • Areal and site-specific survey/historical investigation
  • Hazard assessment for the soil-water impact pathway
  • Hazard assessment for the soil-plant pathway
  • Risk assessment for the soil-human impact pathway
  • Remediation
  • Hazard identification, assessment and defence against harmful soil changes due to soil erosion by water

The contact details of the recognised and notified experts are published in standardised directories.

If you already have a public appointment in accordance with § 36 GewO in the requested field and have completed suitable further training, you often also provide proof of the necessary expertise for recognition in accordance with § 18 BBodSchG in conjunction with the respective ordinance. This means that there are some experts who, in addition to their public appointment in accordance with Section 36 GewO, are also recognised in accordance with Section 18 BBodSchG.

Note: Experts whose expertise, reliability and technical equipment have been checked in another federal state in accordance with comparable requirements are usually also recognised as experts in accordance with Section 18 BBodSchG in the federal states. A new examination is not necessary.

Please note! The recognition and notification authorities responsible for this vary from state to state. These are often the chambers of industry and commerce, but the chambers of engineers, chambers of agriculture or state offices may also be responsible.

Erforderliche Unterlagen

  • Curriculum vitae and complete description of professional activities and expert activities to date
  • Passport photo (also digital)
  • Certificate of good conduct "for submission to an authority" in the original in accordance with Section 30 (5) BZRG (not older than three months)
  • Original extract from the central trade register "for submission to an authority" in accordance with Section 150 (5) GewO (only required for commercial activities)
  • Original tax clearance certificate/certificate in tax matters from your responsible tax office
  • Copy of your liability insurance for personal injury, property damage and financial loss
  • Notarised copies of certificates (professional qualifications, diplomas, doctoral certificates), copies of professional awards
  • Certificates of attendance at specialist and expert seminars, copies of certificates of employment and service (e.g. certificates from your last/current employer)
  • Five self-prepared expert reports per subject area that are suitable as proof of expertise in the subject area applied for
  • Expert report journal for the last two years
  • Further training certificates from the last two years

Voraussetzungen

  • You have the necessary, comprehensive expertise.
  • You have the necessary technical equipment.
  • You are personally reliable.
  • You have the necessary liability insurance for expert activities.

Kosten

The fees vary. The calculation is based on the IHK fee schedule.

  • Fees Cost range: EUR 300.00 - 2,500

Expenses for specialised committees and information must be added.

  • Costs/fee for the review in the expert committee: EUR 1,000 - 3,000

Verfahrensablauf

The inspection of experts in accordance with Section 18 BBodSchG is regulated differently in each federal state and is carried out in accordance with the ordinance applicable in the respective federal state.

  • You first submit a written application. The application must state the subject area(s) for which the application is to be submitted.
  • Together with the application, you must submit further documents listed in the application.
  • You will receive a notification of fees. The fees are generally due when the application is submitted.
  • The recognition authorities will also check your reliability, technical equipment and liability insurance.
  • Your technical suitability is checked by committees or specialised bodies for soil protection and contaminated sites. You must also bear the costs here.
  • The review procedure usually consists of an assessment of the expert reports you have submitted as well as a written report and a technical discussion.
  • You will generally be informed of the result of the review in writing. On request, the decision can be explained in an interview.
  • If the recognition authority has checked all the requirements and your professional suitability/expertise has been established, you will be recognised and notified by means of a decision and you will receive a certificate.

Your recognition will be published in the nationwide list of experts and also announced in the publication organ of the recognition authority.
