Application for a partial building permit in accordance with Section 74 of the Saxon Building Code (SächsBO)
You can apply for a partial building permit if you have applied for a building permit and would like to start work on the excavation pit or individual building components or construction phases before the building permit is granted.
To do this, you submit an application for partial building authorisation to the responsible lower building supervisory authority. In the application, you specify which parts of the building you would like to start on before the building permit is granted. The part of your building project that is already covered by the partial building permit will no longer be decided as part of the building permit.
Application for extension in accordance with § 73 SächsBO
If you have been granted a partial building permit for the construction, modification or change of use of a facility for your building application, you can apply for an extension of the partial building permit. The competent lower building supervisory authority can extend the partial building permit by a maximum of two years in each case if the legal requirements have not changed in the meantime and the application has been received by the competent lower building supervisory authority before the deadline expires.
Prerequisite: Construction work has not yet begun or construction work has been interrupted for more than two years.
The extension of the partial building permit is subject to a fee.
Depending on the part of the building project you wish to start with in advance and in the event that the documents have not already been submitted with the actual building application:
- Site plan with written part
- Extract from the property map
- Construction drawings
- Building description
- Proof of stability
- Fire protection certificate
- Noise protection certificate
- Vibration protection certificate
- Declaration of the qualified structural engineer
- Information on water supply and wastewater disposal systems, including a pipework plan of the water and wastewater pipes on the property

- the part of the project does not conflict with any public law regulations and
- the overall construction project is generally permissible

You can submit your building application online (-> Online application) or in writing, depending on the regulations of the respective lower building supervisory authority .
Online application
To use the online service, you must be registered for a bundID account or for your company's My Company account.
- Follow the link above under -> Online application and log in to bundID or your company's My Company Account via the start page.
- First select your role (client, design author, representative) and, if necessary, invite other parties to process the online application.
- The majority of the building documents are submitted via attachments in PDF format, including the property map, site plan, construction drawing, building description, stability certificate and fire protection certificate. The individual documents can be uploaded to the designated location in the online application using drag & drop.
- Once all mandatory fields have been completed correctly at each point in the online application, the persons involved (e.g. client and designer) can sign the application.
The signatures of the persons involved are replaced by secure identification and authentication via the bundID user account or the My Company Account user account .
Written application
- Submit the required documents with an informal, signed cover letter to the responsible lower building supervisory authority.
Examination
- The lower building supervisory authority will review your submitted application, taking into account the entire construction project. If documents are still missing or there are other deficiencies, you will be given a reasonable period of time to submit them.
- Start of construction: within 3 years
Note: The building permit expires if the construction project is started after this period or if construction is interrupted for more than two years.
