If your project crosses a body of water or takes place in or on a body of water, you require a permit for this, which you will receive if the approval requirements are met.
If you are planning a project that is to take place in, on, above or below a body of water, you require a permit.
If you wish to construct a facility or make significant changes to an existing facility in, above, below, over or on surface waters, you require a permit from the competent authority.
Installations can be Bridges, footbridges. Pipelines, cable lines, watercourse crossings, buildings, underpasses, port facilities, landing stages, pipelines, ferries, dams, culverts, supply and disposal lines parallel to the watercourse, bank reinforcements, property enclosures, land filling or removal.

The project must not be expected to adversely affect the public good, in particular public safety or order, which can neither be prevented nor compensated for by conditions or requirements.
Building regulations remain unaffected.

You can apply for a permit for the construction or substantial modification of a facility in, on, over or under a body of water in writing or online via the relevant online service.
Once you have submitted the application, the process continues as follows:
- The authority checks the application documents; if necessary, it requests documents and involves any bodies concerned.
- If necessary, you submit further documents and the body or bodies concerned submit their comments.
- On the basis of the documents submitted and the comments received, the authority checks whether a permit can be issued.
- If your application is approved, you will receive a notice of approval for the installation in, on, over and under a body of water.
- You pay the administrative fee.
The processing time after submission of the complete application documents is 4 weeks in simple cases, but can be longer depending on the complexity of the individual case.
The State Office for Environmental Protection and Occupational Safety is not responsible in the following cases:
- If a permit, approval or notification is required for the project in accordance with building regulations, the building supervisory authority shall decide in agreement with the State Office for Environmental Protection and Occupational Safety. This does not apply to installations that require a permit or authorization for use, maintenance or expansion of the watercourse, a mining permit or other official approval under the Water Resources Act or this Act.
- Federal or state installations do not require a permit if the public client has assigned the management of the design work and construction supervision to a civil servant of the higher civil engineering administrative service.
