If your animals were killed as a result of measures ordered by the authorities to combat animal diseases, you can apply for compensation from the relevant state authorities.
Compensation is a statutory benefit in accordance with the provisions of the Animal Health Act. The compensation is based on the fair market value of the animal before the illness and takes into account certain maximum rates per animal species. Please note that no compensation is granted for animals owned by the federal or state governments or for animals that were imported contrary to applicable regulations.
The Saarland Animal Disease Fund pays compensation for the loss of animals and reimburses costs incurred for the utilization or killing of animals.
In order to be entitled to compensation, no culpable violations of animal disease regulations must have been committed. As a rule, applications for compensation must be submitted within 30 days of the animals being killed.
The application must be submitted in writing to the competent veterinary office (State Office for Consumer Protection) in compliance with the deadlines. In some cases, compensation may be partially granted if the complete refusal of compensation would constitute undue hardship.

The veterinary office processes the case and then forwards all the documents to the Saarland Animal Disease Fund. This examines and decides on the application.
For animal species subject to contributions - in Saarland these are cattle, horses, pigs, sheep, goats, chickens and turkeys - half of the funds are paid by the animal disease fund from the contributions of the Saarland livestock owners and half from the Saarland.
In the case of non-contributory animal species - e.g. bees and game - the Saarland bears 100% of the compensation payments; here the Animal Disease Fund is only responsible for determining and paying the benefit.
Amount of compensation
The amount of compensation is based on the fair market value of an animal. The fair market value is determined by the price that could be achieved in the ordinary course of business in the event of a sale. Future or collector's values are not taken into account.
In addition to the fair market value of the animals, the costs of killing or slaughtering are also reimbursed. Recoverable parts of the animals are to be offset against the compensation, i.e. proceeds that are achieved through slaughter, for example, reduce the compensation.
Likewise, veterinary treatment costs, cleaning and disinfection costs and consequential economic losses such as rejections or economic losses as a result of lockdown measures are not compensated.
Estimation procedure, reduction of compensation:
The amount of compensation is to be estimated by an official veterinarian.
The compensation is determined by the Saarland Animal Disease Fund and paid out on behalf of the state. It may not exceed certain maximum values per animal in accordance with § 16 of the Animal Health Act:

The amount of compensation is reduced by 50% for animals that have demonstrably died of the disease before the suspected animal disease notification is submitted. This does not apply to anthrax, rinderpest and rabies or to cattle that have been diagnosed with Aujeszky's disease after death.
