§§ Sections 3 and 6 of the Ordinance on Commercial Auctions (Auction Ordinance - VerstV)
Anyone wishing to hold an auction must give prior written notification. An auction must be notified at least 2 weeks before the planned auction date. The notification, including copies of the documents, must also be sent to the responsible Chamber of Industry and Commerce.
If you wish to hold an auction, you must notify the competent authority in writing/via the online form.
If you wish to auction unused goods, one of the following exceptions must apply:
- The goods come from
- an estate,
- an insolvency estate or
- a business closure or
- the goods are being sold by public auction on the basis of statutory regulations.
No notification is required for the auction of agricultural inventory, agricultural and forestry products or livestock
The notification, including copies of the documents, must also be sent to the relevant Chamber of Industry and Commerce.
The advertisement must include the following details
- Place and time of the auction and
- the type of goods to be auctioned
and must be made in writing.
If the auction involves goods that
- belong to an estate or an insolvency estate or
- are sold due to the closure of a business or
- are sold by public auction on the basis of statutory provisions (Section 383 (3) of the German Civil Code) and
- are offered in open sales outlets and which are unused or whose intended use consists in their consumption, the written notification must also include
- the reason for the auction and
- the name and address of the customer
must be stated.
In order to be able to notify the competent authority of an auction, you must have a valid license to operate as an auctioneer in accordance with the Trade, Commerce and Industry Regulation Act.
No notification is required for the auctioning of agricultural inventory, agricultural and forestry products or livestock (see Section 3 (1) sentence 2 of the Auctioneers Ordinance).
Subsequent notification of individual auctioned items is possible if the requirements of Section 3 (2a) of the Auctioneers Ordinance are met.
A new auction may only be started at the location of the previous auction if the previous auction ended at least 5 days ago. An auction may not exceed a duration of 6 days. In individual cases, the local authority may grant exceptions to the above time limits. (cf. § 3 Para. 3 of the Auctioneers Ordinance).

Note: Under certain circumstances, the notification period can be shortened. To do this, please submit a separate "Application for exceptions to the Auctioneers Ordinance in the context of notification of an auction". You must submit this application separately because it involves an administrative act.
The notification must be made no later than 14 days before the auction date. The date of receipt of your auction notice is decisive for compliance with this deadline.
In exceptional cases, particularly in the case of perishable auction goods, the deadline can be shortened upon request. To do so, please submit the separate "Application for exceptions to the Auctioneers Ordinance in the context of notification of an auction".
This procedure can also be handled via a "Single Point of Contact". The "Single Point of Contact" is a special service offered by the municipalities and the state for service providers.
