If you want to organize commercial shows of people in your business premises or make your business premises available for such events, you need a permit for this.

If you wish to hold a commercial event in your business premises for the exhibition of persons such as striptease or table dance, you will need a permit for this.

You also require a permit if you wish to make your business premises available for such an event.

It generally only applies to the specified room and the applicant personally.

Performances of a predominantly artistic, sporting, acrobatic or similar nature are exempt from the permit requirement.

It is not based on public events, so that performances in front of only one spectator are also covered.

As a rule, a permit for the exhibition of persons is granted for an unlimited period. However, it can also be issued for a limited period. If you would like to apply for an extension, the same conditions apply as for the initial granting of the permit.

The permit is tied to a specific person and location. It can be issued for individual events but also for regular events. The permit may be subject to conditions (including retrospective conditions) if this is necessary to protect the general public, guests or residents of the premises or neighboring properties from danger, significant disadvantages or considerable nuisance.

The requirements for obtaining a license are

1. You must have the necessary reliability for the business operation.
2. The shows must not be contrary to public morals.
3. The commercial operation must not be contrary to the public interest with regard to its local location or the use of the premises, for example if it could have harmful effects on the environment within the meaning of the Federal Immission Control Act (BImSchG) or other significant disadvantages, dangers or nuisances for the general public.

The fees for a permit for the commercial staging of shows by persons (§33a GewO) for one-off performances of this kind are currently between 60 and 800 euros.

The administrative fees are set in accordance with the Act on the Levying of Administrative and User Fees in the Saarland (SaarlGebG) in conjunction with the General Fee Schedule for the Saarland (GebVerz) (here: item 385.11).

In the event of rejection:

If an application to carry out an official act is withdrawn before it is completed, up to 75 percent of the full fee is payable, depending on the expenses already incurred (Section 9 (2) SaarlGebG).

1. You must apply to the competent authority for a permit to exhibit persons.
2. After the examination, you will either receive the permit or a rejection notice. A permit may be subject to certain conditions.

The permit is deemed to have been granted if the authority has not made a decision on your application within three months of receiving the complete documentation.

• The permit is independent of any notification of the restaurant business that may otherwise still be required.
• Violation of the permit requirement and violation of an enforceable condition may be punished as an administrative offense with a fine; persistent repetition of the violation of the permit requirement may be punished as a misdemeanor with imprisonment or a fine.
• The permit expires if the holder has not commenced operation within one year of its issue or has not operated the business for a period of one year.
• For the extension of a temporary permit, the requirements must be re-examined, therefore an extension is equivalent to a new application.

An appeal against the decision can be lodged with the competent authority.
