As the operator of an evaporative cooling system, a cooling tower or a wet separator, you are obliged to inform the competent authority immediately in accordance with Annex 3 Part 1 of the 42nd BImSchV and within a period of 4 weeks in accordance with Annex 3 Part 2 of the 42nd BImSchV if a laboratory test reveals that the action values for the concentration of legionella in process water specified in Annex 1 of the 42nd BImSchV have been exceeded. The competent authority will receive the information and check the measures you have initiated. If necessary, the authority will also contact you.

Information in accordance with Annex 3 Part 1 or 2 of the 42nd BImSchV and in particular

• Result of the laboratory test in which the exceedance of the action value according to Annex 1 was determined (§ 10 sentence 1 number 1 of the 42nd BImSchV),
• Result of the test for the differentiation of legionella according to § 9 paragraph 1 number 1 (§ 10 sentence 1 number 2 of the 42nd BImschV),
• Result of the additional laboratory test according to § 9 paragraph 1 number 3 (§ 10 sentence 1 number 2 of the 42nd BImschV).

When using the web application KaVKA-42.BV, all required information is requested.

As the operator of an evaporative cooling system, a cooling tower or a wet separator, you are obliged to inform the competent authority if a laboratory test reveals that the action values for the concentration of legionella in process water have been exceeded.

The costs are based on the fees set by the responsible immission control authorities.

The nationwide standardised web application KaVKA-42.BV is available for operators of to fulfil their information obligations.

The use of the KaVKA-42.BV web application is mandatory in Baden-Württemberg for all notification obligations under § 13 and for all information obligations under § 10 of the 42nd BImSchV. In addition, the web application can be used for notifications under § 14.

If a measure value is exceeded, you are obliged, among other things, to inform the competent authority immediately in accordance with Annex 3 Part 1 and within a period of 4 weeks in accordance with Annex 3 Part 2.
