Persons who wish to take over a restaurant business requiring a permit from another person may be permitted to operate the restaurant business until the permit is granted on a provisional basis. The temporary permit should not be granted for longer than 3 months. The period may be extended if there is good cause.

• Fully completed application
• Certificate of good conduct and information from the central trade register (both documents must be requested from the municipality of residence)
• Information on entries in the debtor register of the local court in whose district the applicant has had his/her residence or commercial establishment in the last 3 years
• Floor plans and site plans of the rooms intended for the operation of the business and for the residence of employees in duplicate
• Lease or rental agreement or proof of ownership
• tax clearance certificate
• Proof of instruction from the Chamber of Industry and Commerce
• for legal entities (associations, limited liability companies, etc.), an extract from the commercial register and the shareholders' agreement or articles of association

• Costs for issuing a provisional permit: 51.00 euros to 256.00 euros
• Information from the central trade register: 13.00 euros
• Certificate of good conduct: 13.00 euros
• Stax clearance certificate from the tax office is free of charge

As a rule, the temporary restaurant permit is limited to a maximum period of validity of 3 months. It can be extended at a later date at the request of the holder - repeatedly if necessary - provided there is good cause for doing so. Good cause exists in particular if the granting of the final permit applied for is delayed for reasons for which the applicant is not responsible.

Chambers of industry and commerce, chambers of skilled trades, districts, independent cities, local authorities and the administration of independent municipalities provide support with the application process.

• Provisional permit and provisional deputy permit is stipulated in accordance with Section 11 of the Federal Catering Act
• Permission to exercise a restaurant business requiring a permit on revocation can be granted until the permit is issued if the business is taken over by another person
• The applicant must be reliable.
• The administrative fee is 51.00 to 256.00 euros.
