Transport companies that transport animals on their own account or for a third party must be licensed. In addition, all persons involved in the transportation of animals in companies must be in possession of a certificate of competence issued by the authorities.
The various legal bases regulate, for example, the handling of the animals during loading, the space required for the animals, the provision of care for the animals during transportation and the duration of transportation. Particular attention is paid to compliance with the legal requirements.

1. approval as a transport company

Transport companies must be approved by the competent authority of the Member State in which they are based and in which they apply for approval in accordance with Article 10 or 11 of Regulation (EC) No. 1/2005 if they carry out transports that exceed 65 km, in accordance with Art. 6 Para. 7 (EC) 1/2005.
The authorization may only be applied for from a single authority and only in one Member State and must be limited to a maximum of 5 years. The approval is granted in accordance with Art. 10 or 11 of Regulation (EC) No. 1/2005 and is limited to a maximum of 5 years if the relevant requirements are met. The application for approval can only be submitted to the local competent authority. It may not be submitted in another Member State or even in several Member States.

The requirements for the authorization depend on the duration of the planned transport:

  • Type 1 of authorization applies to transporters who transport animals for a maximum of eight hours,
  • Type 2 applies to transporters who transport animals for longer than eight hours (= long transportation).

2. approval of means of transport

On request, the competent authority can issue a certificate of approval for road transport vehicles used for long journeys and for transport vessels. Truck trailers and semi-trailers require their own certificate of approval.
For purely national transports over 8 to 12 hours, the means of road transport do not require a corresponding approval in accordance with the Animal Welfare Transport Ordinance (only applies to the transport of breeding and farm animals).

Certificate of competence: In accordance with Art. 6 Para. 5 of Regulation (EC) No. 1/2005, persons who drive or accompany road vehicles on which domestic equidae, domestic cattle, domestic sheep, domestic goats, domestic pigs or poultry (in connection with an economic activity) are transported must have a certificate of competence in accordance with § 17 Para. 2 of Regulation (EC) No. 1/2005. To apply for this in Mecklenburg-Vorpommern, please contact the competent veterinary and food inspection offices of the districts and independent towns.

Voraussetzungen

1. acquisition of the certificate of competence

The certificate of competence is acquired in accordance with the provisions of Annex IV of Regulation (EC) No. 1/2005 and Section 4 of the Animal Welfare Transport Ordinance:

  • successful completion of a full training course in accordance with the requirements of Annex IV No. 2 and
  • passed an examination recognized by the competent authority

2. alternative acquisition of the certificate of competence through vocational training completed after January 5, 2007

Alternatively, the certificate of competence shall also be issued upon application if evidence is provided of vocational training completed after January 5, 2007 in the professions of butcher (specializing in slaughtering), farmer, horse farmer, animal keeper, animal keeper or comparable vocational qualification as well as successful completion of a university or university of applied sciences degree in the field of agriculture or veterinary medicine after January 5, 2007.
This also applies to proof of a certificate of competence passed after January 5, 2007 and before February 19, 2009 in accordance with Section 13 (3) of the Animal Welfare Transport Ordinance in the version published on June 11, 1999.

By means of a case-by-case examination, the required expertise within the meaning of Section 4(1)(2) of the Animal Welfare Transport Ordinance of February 11, 2009 can also be provided by appropriate evidence that the relevant requirements of Annex IV No. 2 of Regulation (EC) No. 1/2005 have been the subject of training and independent examination.

3. acquisition of the certificate of competence through a certificate of competence acquired before January 6, 2007 or vocational training completed before January 6, 2007

Persons who were already in possession of a certificate of competence in accordance with Section 13 (3) of the Animal Welfare Transport Ordinance in the version published on June 11, 1999 before January 6, 2007 or who completed vocational training in the professions of butcher (training in the field of slaughtering), farmer, horse farmer, animal keeper, animal manager or comparable professional qualifications before January 6, 2007 as well as successfully completing a course of vocational training in the field of animal welfare before January 6, 2007. Applicants who can prove that they have successfully completed a university or university of applied sciences course in agriculture or veterinary medicine before January 6, 2007 only need to complete a supplementary course in accordance with Annex IV No. 2(a) of Regulation (EC) No. 1/2005 and take an examination (e.g. multiple-choice test).
The certificate issued by the training institution is proof that the supplementary course has been completed and the examination passed. After submitting this certificate and proof of the above-mentioned completed training, the certificate of competence can be applied for. Alternatively, the applicant may provide the authority with proof of knowledge in accordance with Annex IV No. 2(a) of Regulation (EC) No. 1/2005 in another form.

The certificate of competence is issued on application by the competent authority for the applicant's main place of residence, usually the veterinary and food inspection authorities, provided that the requirements for this are met.

Kosten

A fee of EUR 25.00 is charged for the certificate of competence in accordance with fee item 1.6.25 of the Veterinary Administration Costs Ordinance.

  • The provisions of Council Regulation (EC) No. 1/2005 of December 22, 2004 on the protection of animals during transport and related operations and amending Directives 64/432/EEC and 93/119/EC and Regulation (EC) No. 1255/97 (EU Regulation) apply to the transportation of animals.
  • In addition, the provisions of the Ordinance on the Protection of Animals during Transport and the Implementation of Council Regulation (EC) No. 1/2005 (Animal Welfare Transport Ordinance national) are also applicable.
