With a partial building permit, you can start construction work to change the use of building sections before the building permit is granted. To do this, you submit an application for partial building permission to the responsible lower building supervisory authority.
If you have applied for a change of use permit and would like to start changing the use of part of the building before the permit is granted, you will need a partial building permit for this change of use. To do this, you submit an application for a partial building permit to the responsible lower building supervisory authority.
In the application, you specify the parts of the building for which you wish to begin the change of use before the permit is granted.
The partial building permit for the change of use of a facility is subject to a fee.

You receive a partial building permit for the change of use:
- if the underlying building application is complete with regard to the changes of use units requested for the partial building permit,
- the described building project complies with the public law regulations to be examined in the building inspection procedure.
- Fee range: EUR 60.00 to EUR 1,680
- The fee for the individual partial building permit, insofar as it exceeds EUR 180.00, can be offset against the fee for the building permit, taking into account a lower review effort in the building permit procedure.
- The cost calculation takes into account the expected costs of the construction work and the work involved in checking the parts of the building application relevant to the partial building permit.
You can apply for a partial building permit for the change of use of a facility using the online procedure or in text form.
Submit the application, stating which building application your application for partial building permission relates to and which construction measures it covers. Attach the required building documents. Submit the application documents to the responsible lower building supervisory authority.
The lower building supervisory authority will review your application and involve the municipality and those bodies whose involvement or consultation is required for the decision on the partial building permit or without whose opinion the approvability of the application cannot be assessed. You will then receive the decision on your application.
The partial building permit is subject to a fee. You will receive a notification of fees. If necessary, the lower building supervisory authority will ask you to pay a fee in advance after you have submitted your application.
- In the regular partial building permit procedure, there is no application deadline and no approval deadline.
- The partial building permit expires if work on the modification project has not begun within three years of it being granted or if work has been interrupted for more than one year. The application can be extended by up to one year within the period of validity.
- If a partial building permit has been granted, the lower building supervisory authority must be notified of the start of construction at least one week before the start of construction work.
