If you want to fell a tree or other woody plant between March and September, you need a special permit.
Trees produce vital oxygen, improve the climate, filter dust and pollutants and provide humidity and air movement. They provide a habitat for a wide variety of animals, enliven and structure the cityscape or townscape and dampen noise. To ensure that trees are preserved, they require special protection - especially in densely populated areas.
If you wish to fell a tree, a permit may be required. You may have to pay compensation for the felled tree. A felling permit is particularly necessary if trees are subject to special protection.
The felling of trees and other woody plants is prohibited between March 1 and September 30. It is also forbidden to cut them down. You may only prune trees and other woody plants for maintenance purposes. If you need to cut down a tree during this period, for example because it is a hazard to road safety, you will need a special permit.
This ban protects the nesting, breeding, living and habitats of wild animals (e.g. birds, bats).
You want to remove or cut back trees, hedges, living fences, bushes or other woody plants in the period from March 1 to September 30.
If it is a tree, you only need the exemption permit if the tree is located outside a forest, a short rotation plantation or an area used for horticultural purposes.
You do not need a special permit for careful shaping or pruning. However, you must ensure that you do not expose any nests or otherwise damage individuals or habitats. Otherwise you may be committing an administrative offense.
Before you remove or cut back a tree, hedge, living fence, shrubbery or other woody plant from March 1 to September 30, you must apply for an exemption from your local authority.
In the application, you must tell the authority what type of vegetation you wish to remove or cut back, the location and the time. You must also explain why an exemption is necessary for you.
The competent authority will then decide whether you will receive an exemption. In national parks and biosphere reserves, the national park office or biosphere reserve office is responsible.
You must have the special permit before you remove or cut back the vegetation. Otherwise you may be prosecuted for an administrative offense.
