If you operate sunbeds as part of a tanning salon or in the area of other commercial enterprises, such as hotels or fitness clubs, you must fulfill certain obligations. These are monitored by the responsible health authority. Initial monitoring takes place after commissioning and then every five years or as required.
As the operator, you must ensure that minors do not have access to the sunbeds.
The obligations for sunbed operators arise from the UV Protection Ordinance in accordance with § 5 Para. 2 NiSG:
- when operating the systems, certain limit values must not be exceeded on the systems
- the systems must be subjected to a technical inspection at regular intervals
- the operators must comply with consultation and information obligations
- warning notices must be affixed to the systems/in the cabins
- the persons working in the company must meet certain technical requirements
- certain evidence must be provided to the competent authority
In addition, users must be provided with UV safety goggles that comply with either DIN EN 170 protection level 2-5 (2001) or DIN EN 60335-2-27 (VDE 0700-27) (2009). These requirements serve to protect people and must be complied with.
The operator must keep an equipment and operating log on an ongoing basis. All device information and maintenance intervals are recorded in the device log. Information on operation and personnel as well as the repairs and maintenance actually carried out are documented in the operating log.
Operators and personnel are required to provide evidence of their technical suitability in accordance with the new regulation through mandatory training courses and further training every five years. This serves to provide information on the risks, determine the respective skin type and thus select the radiation dose. The training courses can only be carried out by approved providers and a certificate is issued on completion. Equivalent certificates and documents from EU member states or countries of the European Economic Agreement are recognized.
- Business registration; operating license if necessary
- Compliance with the requirements of the NiSG and UVSV
- Presence of a person qualified as a specialist for handling UV irradiation equipment during operating hours
Monitoring is free of charge; in the event of follow-up inspections due to deficiencies, fees are charged in accordance with the cost ordinance for official acts of the health administration (Gesundheitswesenkostenverordnung - GesKostVO M-V).
Solariums are monitored by the relevant health authority in accordance with the State Ordinance on the Determination of Competent Authorities under the Act on Protection against Non-Ionizing Radiation when Used on Humans (NiSGZustVO MV).
