If you can provide evidence of at least three years of effective and regular practice as an established European lawyer in Germany in the field of German law, including Community law in accordance with Section 12 EuRAG, you will be admitted to the bar in accordance with the provisions of Sections 6 to 36 of the Federal Lawyers' Act (Bundesrechtsanwaltsordnung). The actual practice of the profession in the host country without major interruptions is regarded as effective and regular practice. In the event of longer interruptions, the Bar Association shall take into account the reason for and duration of the interruption in each individual case.
Anyone who has regularly practiced as an established European lawyer in Germany for at least three years, but has only worked in German law for a short period of time, will only be admitted as a lawyer if they can prove that they are able to continue practicing their profession. The Bar Association will check this in an interview.
If a national of a member state of the European Union or another state party to the Agreement on the European Economic Area or Switzerland who has completed professional training that entitles him/her to direct access to the profession of European lawyer takes a state aptitude test, he/she may also be admitted to the bar immediately.
For the "Application for Admission to the Bar", the applicant must provide evidence of the number and type of legal cases he has handled in German law and the duration of his activity. He/she shall provide the Bar with all information and documents that are suitable for providing evidence. The Bar Association may ask the applicant to explain his information and documents orally.
Case lists must be submitted as proof of the legal cases handled under German law, which must regularly contain the following information:
- File number
- Subject matter of the case
- period of time
- Type and scope of activity and
- status of the case.
Furthermore, samples of work must be submitted to the Bar Association upon request.
In addition, the following documents must be submitted:
- Application for admission to the bar
- curriculum vitae
- Proof of activity in accordance with § 12 EuRAG,
- current confirmation of membership of the profession from the competent authority in the country of origin (this certificate must not be older than 3 months at the time of submission),
- current proof of professional liability insurance.
For further details, please contact the competent authority indicated.
The Bar Association may require that the certificate of admission as a (European) lawyer is not older than three months at the time of submission.
The bar association responsible for the place of establishment is responsible for admission to the bar. The required aptitude test is carried out by a state authority (e.g. the State Judicial Examination Office).
