Private experts require a license for the testing of cross-checks or duplicate samples within the meaning of the LFGB (as well as tobacco and tobacco products). This authorization is issued by the competent authority for this activity in the country in which they have their headquarters.
As part of the official monitoring of foodstuffs and consumer goods, random samples of foodstuffs, tattooing products, cosmetics, consumer goods and tobacco products are regularly taken to check their marketability.
In the case of official sampling on the basis of the German Food and Feed Code (LFGB, with the exception of animal feed) and the Tobacco Products Act, part of the sample and, if this is not practicable, a second sample of the same type (and from the same batch and manufacturer) must be left behind to enable the manufacturer to obtain a second expert opinion. This sample shall be officially closed or sealed.
Only approved private experts are authorized to examine these officially retained counter or second samples.
Application for approval must be made to the competent authority of the country in which the counter-sample experts have their headquarters.
The requirements for the approval procedure are regulated nationwide in the Ordinance on the Approval of Private Counter-Sample Experts and on Regulations for Official Counter-Samples (Counter-Sample Ordinance - GPV).

Only persons with the following professional training may be approved as cross-check experts:
- state-certified food chemists or
- licensed veterinarians with a specialist veterinary qualification in the field of investigation applied for approval or for public veterinary services or
- Persons with a university degree in natural sciences, if they provide evidence of relevant specialist and legal knowledge by means of suitable documents
Further requirements:
- at least two years of examination and assessment experience in the field of examination applied for
- have a suitable accredited testing laboratory with the appropriate accreditation for the field of testing applied for
- reliable
- not involved in official food, feed and consumer goods monitoring and testing
- free from conflicts of interest when carrying out the work as a cross-checking expert
For persons who are legally established in an EU member state or in another EEA member state (country of establishment) to exercise the profession of cross-checking expert and who wish to work as a cross-checking expert in Germany on a permanent basis, the admission requirements in accordance with Section 2 (2) sentence 1 GPV apply.

You submit your informal written application to the responsible Ministry for Climate Protection, Rural Areas, Agriculture and the Environment, stating the area of investigation (subject area) and the type of products for which approval is to be granted. The required documents must be enclosed. The address of your head office and the address of the registered office of the designated, accredited testing laboratory, including the registration number issued by the accreditation body, must also be provided.
The licensing authority may request further documents to verify personal reliability.
The accreditation authority will check whether the accreditation requirements of the Crosscheck Ordinance have been met and will inform you of its decision. The approval is granted for the requested area of investigation and is subject to a fee.
The approvals granted are valid for the entire federal territory.
Once all requirements have been met, processing usually takes four weeks.
The required documents, with the exception of the training and qualification certificates, must not be older than three months.
