Foster children are often under guardianship or guardianship. A guardian is the legal representative for a child in all matters. In contrast, a guardian is only responsible for a limited area of care.
If a foster child is integrated into their foster family and will remain there permanently, the foster parents can also be appointed as carers or guardians and thus receive custody or parts of custody. When making its decision, the guardianship court will pay particular attention to whether you are suitable for guardianship/custody on the basis of your personal circumstances and financial situation as well as the other circumstances. You can only be assigned guardianship/guardianship if you are of legal age and have legal capacity.
If several suitable persons apply for guardianship/guardianship and if relatives of the foster child are among them, they will usually be given priority.
Either you are proposed to the court by the youth welfare office or you make this proposal yourself in court. In the latter case, the youth welfare office must then make a statement on this proposal.
The court decides on your application, taking into account the best interests of the child, and appoints you as guardian or custodian if necessary. The judge will then swear on oath that the guardian will carry out their duties conscientiously.

- the natural parents (if they still have custody rights)
- the child, if they are older than 14 years (as a general rule, the older the child is, the more important their opinion is)
- the foster parents
