According to EU food legislation, certain businesses that place food of animal origin on the market require approval. These include, for example, slaughterhouses and businesses that process or treat milk, fish, meat and eggs and do not only place these products on the market at the place of production. Commercial kitchens may also fall under the authorization requirement. Exemptions from the licensing requirement exist for primary production businesses, pure transportation or storage activities without temperature regulations and for certain local forms of retail.

We would like to point out that in accordance with cost item 5.2.1 ThürVwKostOMASGFF (Annex to the List of Administrative Costs - Part C) a fee of 150 to 2,100 euros is charged for the final approval. The exact amount is calculated, among other things, on the basis of the working time required for this. The approval check is carried out by a senior civil servant at an hourly rate of EUR 82.
An additional fee is charged for any previous provisional or temporary approval:
- in accordance with cost item 5.2.2 for a provisional or conditional approval, fees of 75-300 euros and
- in accordance with cost item 5.2.3, a fee of EUR 75-300 for an extension of a conditional authorization.
The approval process begins when the food business operator submits an application to the competent veterinary and food inspection office. After the submitted operating documents have been examined, an on-site inspection is carried out to check whether the statutory hygiene requirements are being complied with. The company receives an approval number with the approval notice. This is affixed to the products as an oval identity mark.
Applications must always be submitted via the locally responsible veterinary and food inspection office.
The responsibility for the approval depends on the type of business and the production or processing volume of the business per week. It lies either with the Thuringian State Office for Consumer Protection (TLV) or the locally responsible veterinary and food monitoring office.
