If the adoption of a child living abroad is possible, the adoption applicants are asked by the international placement agency to declare that they are willing to adopt this child. This process must be accompanied.

If you are interested in adopting a child from abroad and a child can be proposed to you for adoption, you will be asked by the foreign placement agency to submit a declaration in which you state your willingness to adopt this child.

A specific form is required for this declaration. The declaration must be "publicly notarized". This notarization can take place in a notary's office or in a youth welfare office. Notarization at a youth welfare office is free of charge. There are costs for notarization at a notary's office.

If you agree to adopt the child proposed to you, you are obliged to fully reimburse various public benefits granted for the child. This obligation lasts for a maximum of 6 years and ends when the child is adopted. There is no full reimbursement obligation for benefits provided for the child if the child has already been adopted. In these cases, you only have to pay a contribution to the costs to the same extent as parents would have to.

Erforderliche Unterlagen

Proof of identity must be provided for the notarization. You must therefore be able to identify yourself with an identity card, passport or comparable document.

Voraussetzungen

  • You have agreed to a child proposal as part of an international adoption procedure.
  • As part of the adoption procedure, the international placement agency must have asked you to make a declaration in accordance with Section 7 (1) AdÜbAG and you must be willing to adopt the child proposed to you.

Kosten

Costs are incurred for notarization in accordance with the applicable scale of fees. The notary's office can provide the exact amount of the costs prior to notarization.

The public notarization of the declaration before the notary of a youth welfare office is free of charge.

Verfahrensablauf

  • If the foreign placement agency has asked you to make a declaration in accordance with § 7 Para. 1 AdÜbAG and you are prepared to adopt the child proposed to you, please contact the agency where you would like to have the document notarized.
    It is best to make an appointment with the office that is to record the deed. Before notarization, the person recording the deed will inform you of the legal consequences of notarization.
  • Notarization can usually take place immediately.
  • The deed is sent to the foreign mediation office.

Bearbeitungsdauer

The necessary legal instructions and questions that may need to be asked before notarization require a certain amount of time. The time required is different in each individual case. In addition, there may be a waiting time on site.

It is advisable to make an appointment for the notarization.

Frist

If the international placement agency asks you to have your declaration notarized, it will set you a deadline by which the notarization must be completed. If you are unable to meet this deadline for compelling reasons but wish to adopt the child proposed to you, you must contact the international placement agency to extend the deadline.
