Retraining is used for professional reorientation, usually because the previous profession can no longer be practiced. They are usually carried out on the basis of recognized training occupations and must therefore be monitored by the bodies responsible for these occupations (e.g. chambers of industry and commerce, chambers of crafts).
As the person undergoing retraining (not the person undergoing retraining, but the organization providing the retraining), you are therefore obliged to notify the relevant competent body of the retraining.
The obligation to notify extends to the essential content of the retraining contract. When concluding a retraining contract, a copy of the contract must be enclosed.
- Proof of the suitability of the retraining center and the personnel employed
- The retraining concept submitted and the retraining contract to be concluded in this regard comply with the content of the training regulations and the training framework plan
- The training provider submits the retraining concept with the necessary documents for the intended retraining measure to the competent body.
- The competent body reviews the retraining concept in accordance with the underlying legal principles and guidelines.
- The competent body informs the person responsible for the measure of the result of the review of the retraining concept and, if necessary, combines this with a consultation.
- There are no legal remedies against the obligation to notify
- If the competent authority subsequently prohibits you from carrying out the retraining:
- Depending on the federal state: Appeal; detailed information on how to lodge an appeal can be found in your notification
- Administrative court action
- Notify the responsible body of the retraining measure
- Notification of retraining in accordance with BBiG Acceptance
- Retraining organizations, such as companies or training providers, that carry out retraining must notify the competent body in writing in advance
