Are you a lawyer from a member state of the World Trade Organization and live and work in Germany? Then you can apply for admission, i.e. admission to a German bar association, under certain conditions.

As a lawyer from a member state of the World Trade Organization (WTO), you may practise your profession in Germany if the domestic bar association responsible for you admits you as a lawyer.

If you practise one of the following professions, you may provide legal services in Germany in the areas of the law of your country of origin and international law once you have been admitted:

Voraussetzungen

  • Admission to a German bar association requires that you
    • belong to a profession that is listed in the Ordinance on the Implementation of Section 206 of the Federal Lawyers' Act and
    • are licensed under the law of your country of origin, i.e. authorized to practice the profession in your country of origin.
  • You have established yourself in Germany and set up a law firm.
  • You observe the German professional obligations and use the professional title that you are permitted to use in your country of origin under local law.
  • When using the professional title, you must state your country of origin in German.
    • In particular, you may not use the designations "Rechtsanwältin" or "Rechtsanwalt". However, the designation "Member of the Bar Association" is permitted.

  • Lawyers from countries outside the European Union (EU) can apply for admission to the German Bar if they come from a country,
    • that is a member of the World Trade Organization and
    • is listed in the current implementing regulation for Section 206 BRAO.
  • Provision of legal services only under the professional title of the country of origin, for example "Attorney of law" or "Advokat"
  • Legal services only in the field of
    • the law of the country of origin and
    • international law
  • Application for admission to the competent bar association
  • Prerequisite:
    • Admission as a lawyer in the country of origin is available
  • Responsible: competent bar association
