If you want to set up a construction site where
- the expected duration of the work is more than 30 working days and on which more than 20 employees will be working at the same time or
- the scope of the work is expected to exceed 500 person days,
you must give advance notice to the competent authority.
The advance notice must be visibly displayed on the construction site and adapted in the event of significant changes.
According to § 2 para. 3 of the Construction Site Ordinance, a safety and health protection plan must be drawn up for several employers or particularly hazardous work and a safety and health protection coordinator must be appointed in accordance with § 4.
Any person who intentionally or negligently fails to provide the competent authority with advance notice, or fails to do so correctly, completely or in good time, shall be deemed to have committed an administrative offense within the meaning of Section 25 (1) No. 1 of the Occupational Health and Safety Act.
