If you want to operate a nationwide system for the disposal of sales packaging, you need an official permit.
The permit can subsequently be provided with ancillary provisions that are necessary to ensure that the conditions existing when the permit is issued are also permanently met during the operation of the system. The permit must be publicly announced and is effective from the time of public announcement.

Once approval has been granted, you must ensure the regular collection of used, empty sales packaging from private final consumers or in their vicinity free of charge throughout the specified catchment area. You must recycle the packaging collected in your collection system in accordance with the legal requirements.

The supreme Land authority responsible for waste management may, at the time of approval or subsequently, demand that the system operator provides adequate, insolvency-proof security in the event that he or his agents fail to fulfill the obligations under this Ordinance in whole or in part and the public waste management authorities or the competent authorities may demand reimbursement of costs due to substitute performance.
