For certain motor vehicles placed on the market for the first time on or after 01.05.2006, the use of digital recording equipment is mandatory. This applies to vehicles used for the carriage of goods with a maximum permissible weight, including trailers or semi-trailers, exceeding 3.5 tonnes, as well as vehicles used for the carriage of passengers which, by virtue of their construction and equipment, are suitable and intended for carrying more than nine persons, including the driver. The digital recording device records driving times and rest periods, makes manipulation more difficult to the detriment of general road safety and facilitates checks.
The entrepreneur is responsible for:
- Entering the company card into the digital control device at the beginning and at the end of the vehicle deployment for the company
- the correct use of the digital recording equipment
- ensuring the proper functioning of the digital recording equipment
- easy printing from the digital recording equipment in the event of an inspection
- the correct use of the driver card by the driver
- copying, backing up and archiving (2 years) of the data from the digital recording equipment after 90 days at the latest and the driver card after 28 days at the latest in accordance with § 2 para. 5 of the Ordinance on the Implementation of the Driving Personnel Act (FPersV)
- the deletion of the archived data after expiry of the 2-year period in accordance with the Data Protection Act
The company card gives the operator access to the recording equipment.
The following information must be provided in accordance with § 9 Abs. 1 Verordnung zur Durchführung des Fahrpersonalgesetz (FPersV):
- Name, address and registered office of the undertaking
- Birth and surname, first names, date and place of birth of the entrepreneur or persons appointed to represent the company by law, articles of association or articles of association
The company card is valid for 5 years and can be reapplied for at the earliest 6 months before expiration.
Company cards are issued impersonally to the company and are generally sent directly to the company. Multiple company cards can be issued for one company. The number of corporate cards to be issued in a card number series is limited to a maximum of 62 corporate cards per company. If additional corporate cards are required, an additional card serial number will be required.
The application must be submitted personally by the entrepreneur, an authorised representative or an authorised person.
