§§ 2 and 3 NSpielbG

You can only submit an application for a licence to operate a casino in Lower Saxony to the Lower Saxony Ministry of Finance as part of an ongoing tender procedure.

The Lower Saxony Casino Act (NSpielbG) regulates the requirements for the operation of casinos in Lower Saxony.

According to § 2 of the law, a licence is required for this. The Lower Saxony Ministry of Finance (specialist ministry) can (only) issue a casino licence that entitles the holder to operate up to ten casinos in Lower Saxony.

Admission is only granted on the basis of a public invitation to tender by the Ministry of Education in accordance with § 3 NSpielbG. Only within the framework of this procedure can you submit an application.

A corresponding tender procedure will be carried out before the expiry of the currently valid casino licence on 01.09.2024. An application outside the tender procedure is not permitted.

The detailed requirements and criteria will be determined as part of the tendering process.

The application for a casino license is subject to a fee. Costs are also to be charged if an application for the performance of an official act subject to costs is rejected or withdrawn (§ 1 paragraph 1 sentence 2 of the Lower Saxony Administrative Costs Act).

The fee framework for the granting of a casino licence or the rejection of an application for a licence in accordance with No. 80.1.1 of the cost schedule in accordance with the Ordinance on Fees and Expenses for Official Acts and Services (General Fee Schedule) varies depending on the case.

You can only submit an application for a licence to operate a casino in Lower Saxony in writing to the Lower Saxony Ministry of Finance in the ongoing tender procedure.
