Data subjects can request from any body that processes personal data about them that their data is only stored, but in principle only processed with their consent.
Personal data includes, for example
- general personal data, such as name, address, age, marital status
- physical characteristics, such as gender, skin, hair or eye color, height
- Online data, such as IP address, location data, e-mail address
- Bank data, such as account balances, account numbers
- Identification numbers, such as identity card number or social security number
- Land register entries
- Health information, such as genetic data, medical data
- certificates
With your right to restriction of processing, you can initially prevent your personal data from being processed further. You can only invoke your right to restriction of processing under certain conditions.
You must request the restriction of the processing of your personal data directly online or in writing by post to the public or non-public body processing the data.
If you wish to submit a written request by post or require general information, please contact the authority responsible for you with your questions.
- Copy of your identity card or
- Alternatively: Copy of your passport in connection with the copy of your registration certificate
You may request the restricted processing of your personal data if:
- you have requested the rectification of inaccurate data while the data controller verifies this request,
- you have lodged an objection to the processing while it is still being checked whether the interests of the data controller outweigh your interests,
- in the event of unlawful processing, you expressly request restriction instead of erasure, or
- the data controller no longer needs your data, but you still need it for your own purposes.
Costs may be incurred in the case of manifestly unfounded or excessive applications; in such cases, this will be pointed out in advance.
You can request the restricted processing of your stored personal data online or in writing by post.
Request restricted processing of your personal data online:
-
Call up the online form on the state portal. This will guide you step by step through the necessary information, which you can enter electronically.
-
Note: You must provide proof of your identity for the online form. To do this, you must upload a copy of your identity card or passport to the online service together with a copy of your registration certificate or send it to the authorities by post.
-
Upload any required documents as a file (in the file formats PDF, DOC, JPEG, PNG, maximum 10 megabytes per file) and send the form. Alternatively, you can also submit the required documents by post.
-
The public authority will usually send you a corresponding response by e-mail or, at your request, by post to your registration address.
Request restricted processing of your personal data in writing:
- You can submit your request informally.
- Send your request by post to the public authority together with any necessary documents.
The public authority will send you a corresponding reply by post to your registration address.
The processing of your personal data must be restricted immediately, i.e. without culpable delay on the part of the entity processing the data. In principle, you must be informed of the measures taken no later than 1 month after you have requested the restriction. If this is not possible, you must be informed of the reasons for the delay and the extended deadline.
You can contact the authority with a query, lodge a complaint with the State Commissioner for Data Protection of Lower Saxony or take legal action before the competent administrative court.
