Do you intend to make changes to an installation requiring a permit that are relevant to an incident? Then you may need to apply for a permit from the responsible authority beforehand.

Do you operate a plant that is subject to immission control licensing and constitutes an operating area or is part of an operating area, and are you planning to make accident-relevant changes to the plant?

If the accident-relevant change

• the safety distance to neighboring protected objects falls below the appropriate safety distance for the first time,
• the safety distance already fallen below is further reduced, or
• a significant increase in risk is triggered

To do this, you must submit an application for a modification permit and submit all the documents required for the assessment. The application can be made in writing or electronically.

However, approval is not required if and insofar as the obligation to maintain the appropriate safety distance is already guaranteed at the level of a spatially significant plan or measure by binding specifications.

The fees vary depending on the time required. However, a minimum of 1500 euros will be charged.

• Approval is required for accident-relevant changes to installations requiring approval that are an operating area or part of an operating area:
  • if the appropriate safety distance to neighboring protected objects is undercut for the first time as a result of the accident-relevant change,
  • the safety distance, which has already been undercut, is undercut even further, or
  • a significant increase in risk is triggered.
• Approval is not required if and to the extent that the requirement to maintain an appropriate safety distance is already taken into account by other binding regulations.

• Responsible: immission control authority
