Under certain conditions, you can object to the electronic processing of your personal data as part of your right to self-determination under data protection law.
Data subjects may object to the processing of their personal data. Your data may then no longer be processed unless the respective body can demonstrate compelling legitimate grounds that outweigh your interests, or the processing serves to assert, exercise or defend legal claims. You must therefore always give reasons for your objection and the reasons must arise from your particular situation.
Personal data includes, for example
- general personal data, such as name, address, age, marital status
- physical characteristics, such as gender, skin, hair or eye color, height
- Online data, such as IP address, location data, e-mail address
- Bank data, such as account balances, account numbers
- Identification numbers, such as identity card number or social security number
- Land register entries
- Health information, such as genetic data, medical data

You must object to the processing of your personal data directly online or in writing by post to the public or non-public body processing the data.
If you wish to submit a written objection by post or require general information, please contact the authority responsible for you with your questions.

You can object to the processing of your personal data if you can justify that your particular personal situation requires this.
You cannot successfully object to the processing of your personal data if
- there is an overriding public interest that outweighs your interests as the data subject, or
- the processing serves the establishment, exercise or defense of legal claims, or
- there is a legal provision that obliges us to process your data, or
- the data processing is for the purposes of research and statistics and is necessary for the performance of a task carried out in the public interest.
Costs may be incurred in the case of manifestly unfounded or excessive applications; in such cases, this will be pointed out in advance.
Submit an objection online:
- Call up the online form on the state portal. This will guide you step by step through the necessary information, which you can enter electronically.
- Note: You must provide proof of your identity for the online form. To do this, you must upload a copy of your identity card or passport to the online service together with a copy of your registration certificate or send it to the authorities by post.
- Upload any required documents as a file (in the file formats PDF, DOC, JPEG, PNG, maximum 10 megabytes per file) and send the form. Alternatively, you can also submit the required documents by post.
- The public authority will usually send you a corresponding response by e-mail or, at your request, by post to your registration address.
Submit an objection in writing:
- You can submit your objection informally.
- Send your objection by post to the public authority together with any necessary documents.
The public authority will send you a corresponding reply by post to your registration address.
The decision on your objection must be made immediately, i.e. without culpable delay on the part of the body processing the data. In principle, you must be informed of the measures taken no later than 1 month after you have lodged the objection. If this is not possible, you must be informed of the reasons for the delay and the extended deadline.
You can contact the authority with a query, lodge a complaint with the State Commissioner for Data Protection of Lower Saxony or take legal action before the competent administrative court.
