The auctioneer must notify each auction at least two weeks before the planned auction date. The notification must be submitted to the competent public order office in whose district the auction is to take place and to the Berlin Chamber of Industry and Commerce. The notification must be made in writing or electronically and must contain details of the exact location, time and type of goods to be auctioned.
In exceptional cases, particularly in the case of perishable auction goods, the authority may shorten the two-week notice period upon request.
No notification is required for the auctioning of agricultural inventory, agricultural and forestry products or livestock.
Only used goods may be auctioned. Exceptions are new goods or consumer goods that are sold from an estate, an insolvency estate, by way of business closure or at public auctions on the basis of statutory provisions.

Pursuant to Section 1 (1) sentence 1 in conjunction with No. 2.3 of Annex 1 to Section 1 (1) ZustVO-Wirtschaft, the following are responsible for enforcing the Auctioneers Ordinance:
Districts, independent cities, large independent cities, independent municipalities (subject to a deviating regulation pursuant to § 1 para. 2 ZustVO-Wirtschaft)
