For the removal of structures (demolition), the regulations of the Lower Saxony Building Code (NBauO) also apply.

With the exception of high-rise buildings or a part of a structure not listed in the Annex to the Lower Saxony Building Regulations (NBauO), the demolition or removal of a structure does not require notification. High-rise buildings or a part of a structure not listed in the annex to the NBauO must be reported to the competent authority in accordance with Section 60 (3) NBauO.

Irrespective of this, the stability of neighboring buildings must be checked by the building owner if they are built next to each other or if the building ground gives reason to do so.

If a permit, authorization or approval is required for the removal of the facility in accordance with other regulations, this must be obtained before the removal can begin. This depends on the individual case, e.g. according to monument protection, nature conservation or waste legislation.

The notification must be accompanied by confirmation from a structural engineer in accordance with Section 65 (4) NBauO regarding the effectiveness of the planned safety measures and the stability of the structures that are attached to the structures or parts of structures to be demolished or removed or whose stability may be affected by the construction work.

Responsibility lies with the district, the independent city, the large independent city and the municipality with building supervisory powers.
