Companies are given information on who they can contact if they want to start operating a home, a form of assisted living or an outpatient assisted living community and which documents are required.
Residents, their relatives and caregivers, as well as other third parties interested in supportive living services, can make use of their right to advice from the home supervisory authorities.
If you, as a resident of an assisted living facility, are of the opinion that you are not being cared for in accordance with your care and support needs, you can complain to the home supervisory authority. [A1]
As an entrepreneur, you can obtain information and advice on the requirements for operating support facilities.
For the notification in accordance with § 7 Para. 1 NuWG, we recommend using the joint structural survey form of the home supervisory authorities of Lower Saxony and the associations of the statutory care insurance funds in Lower Saxony and enclosing the documents required therein. You can obtain the structural survey form from the responsible office, which is also available to provide you with information on the required documents.
The fee for the examination of the notification to start operating a home is 30.00 euros per place, but at least 300.00 euros.
Anyone wishing to start operating a care home must notify the care home supervisory authority of their intention at least three months before the planned start of operations. The takeover of an existing home must be notified at the earliest possible date. The home supervisory authority shall request the documents required for the inspection.
The processing time varies from one home supervisory authority to another. However, it largely depends on whether all the required documents have been submitted. In addition, the processing time for newly constructed buildings or buildings in which a care home is being operated for the first time depends on an inspection by the home supervisory authority.
The notification must be submitted to the competent authority at least three months before the planned start of operations. The takeover of an existing home must be notified at the earliest possible date.
Home supervision
The operation of a retirement/nursing home must be reported to the responsible home supervisory authority.
For the notification of nursing homes, forms of assisted living and outpatient assisted living communities for elderly people in need of care within the scope of the Lower Saxony Act on Assisted Living, the responsibility lies with the district, the independent city and the large independent city in whose area the facility is to be operated. The Lower Saxony State Office for Social Affairs, Youth and Family is responsible for corresponding facilities for people with disabilities.
