The hunting lease is a lease agreement in the form of a legal lease by which the right to hunt in a specific hunting district is granted to another party (hunting leaseholder). It must be notified to the competent authority.

The lessor (hunting cooperative, owner or usufructuary of the hunting district) is obliged to grant the lessee unhindered and undisturbed hunting within the agreed spatial and temporal limits. Above all, the leaseholder is obliged to pay the agreed hunting lease price on time and to fulfill the shooting plans, as well as to compensate for any damage caused by game, if and to the extent that he has accepted this in the hunting lease agreement.

The hunting lease must meet certain requirements which, if breached, lead to nullity.

For example: It must be concluded in writing. A leaseholder may only be a person who holds an annual hunting license and has previously held one for three years in Germany. The total area on which a leaseholder is entitled to exercise the right to hunt and the number of co-leaseholders are limited. The hunting lease must be notified to the lower hunting authority.

Expiry
The hunting lease expires in particular if the tenant's hunting license has been incontestably revoked. It also expires if the period of validity of the hunting license has expired and either the competent authority has incontestably refused to issue a new hunting license or the lessee does not apply for an annual hunting license within a reasonable period of time set by the hunting authority or does not meet other requirements for this.

The contract must be notified to the competent authority.

The authority may object to the contract within three weeks of receipt of the notification, in particular if it violates the conservation objective or if the minimum lease term of 9 years (for small game hunting grounds) or 12 years (for big game hunting grounds) is not complied with. The objection, if it is incontestable, leads to the termination of the hunting lease if the defect has not been remedied by the contracting parties within the set period.
