If you are entitled to inspect the land register or the land file on the basis of a legitimate interest (see Land register, Inspection), you can request the land registry to issue a copy of the land register. If you wish, the copy can be certified by the land registry.
In the states which - like Bavaria - keep the land register by machine, the printout takes the place of the transcript and the official printout takes the place of the certified transcript. The official printout is provided with an official seal or stamp and is equivalent to a certified copy.
Land register extracts can be applied for either in person by presenting an identity card or passport, in writing or by fax (but not by e-mail) or online with a personal BayernID at the relevant land registry office or local court. The creation and transmission of land register extracts cannot be based on a telephone application, as the existence of a legitimate interest in accordance with § 12 (GBO) would not be verifiable for the land registry in this case.
The application can be made informally or using the form provided here or online at the relevant land registry office.
The application should include the land register page number. If this is not known, the parcel number or an exact location designation can also be provided.
A fee of €10 is charged for uncertified copies/printouts from the land register in accordance with No. 17000 KV GNotKG (schedule of costs for the German Court and Notary Costs Act). The fee for certified copies/official printouts is €20 in accordance with No. 17001 KV GNotKG.
You will receive an invoice from the Landesjustizkasse Bamberg for the fees incurred. Please do not send cash or checks to the land registry.
An increasing number of fee-based services are being offered on various websites to provide owners with land register printouts. The land registry has nothing to do with these service providers. The processing fee due there is often significantly higher than the court fees actually incurred.
You can request your land register printout directly from the land registry at any time using the form, stating your legitimate interest.
