If you require a medical examination certificate to carry out a medical examination in accordance with the Youth Employment Protection Act, you must apply for one.
According to the Youth Employment Protection Act, persons under the age of 18 must undergo an initial examination before starting work and a follow-up examination one year after taking up employment. This is to prevent young people from being employed in work that endangers their health or development.
The application for an examination authorization certificate must be submitted to the trade supervisory office of the responsible government if the young person did not attend a Bavarian school or is no longer in possession of the examination authorization certificates that they received from the school.
The young person or the company must submit the application for an examination authorization certificate for the initial examination in good time before starting work. Together with this application, the young person or the company should also apply for the issue of an examination authorization certificate for the first follow-up examination if they have not yet reached the age of 18 one year after taking up their first employment. Applications for further follow-up examination authorization certificates must be submitted as required.
The initial examination must be carried out within the last 14 months before starting work and the first follow-up examination must be carried out between the 10th and 12th month after starting work. The certificate confirming that the initial examination has been carried out must be submitted to the company before the start of employment. The certificate confirming that the first follow-up examination has been carried out must be submitted one year after taking up the first job, but no later than fourteen months after taking up the first job. Further follow-up examination authorization certificates can be applied for after a further year, if the examination was carried out more than 14 months previously or for supplementary or extraordinary follow-up examinations, which can be arranged by examining doctors in special cases.
If young people are employed on a marginal basis or for no longer than 2 months in light work that is not likely to be detrimental to their health (e.g. vacation work, internships), no medical examinations are required.
You need a certificate of eligibility if you
- are not yet 18 years old,
- would like to take up work and
- this work is not marginal and lasts longer than 2 months.
Note: Children (not yet 15 years old) only require a certificate of eligibility if they are no longer required to attend school full-time and wish to take up work to the extent specified above
The examination authorization certificates can be issued by the trade supervisory office under the following conditions:
- The young person attends or attended a general school in Bavaria and is no longer in possession of an examination authorization certificate that they received from the school and does not receive another examination authorization certificate from their school (e.g. because it is vacation time or it has been some time since they graduated from school).
- The young person does not attend or did not attend a Bavarian school. However, he/she is or will be employed in Bavaria.
However, if he/she is in possession of an examination authorization certificate from another federal state, the necessary examination must be carried out with the examination authorization certificate issued by the respective federal state. There is a free choice of doctor. - An additional examination authorization certificate is required because, for example
- the initial examination was more than 14 months ago,
- a further follow-up examination is required because the young person has not yet reached the age of 18, or
- either the doctor or the trade supervisory office has ordered an (extraordinary) follow-up examination.
none
Important Note:
Please make an appointment for the examination in good time. The examination is free of charge with many doctors. If a doctor's practice only offers the examination on a private bill, you can also ask another doctor's practice, e.g. your family doctor's practice. A follow-up examination can also be carried out by the company doctor at the place of training or work.
The Bavarian state government cannot reimburse the costs of a private bill.
The application must be submitted to the trade supervisory office of the government in whose district the young person lives or, if their place of residence is outside Bavaria or Germany, is employed or is to be employed.
The examination authorization certificate must be applied for before the examination and handed over to the doctor during the examination.
The young person or the company must submit the application for an examination authorization certificate for the initial examination in good time before starting work.
If the young person is still attending a general school in Bavaria, the school will issue the examination authorization certificate.
