www.gesetze-im-internet.de/whg_2009/__9.html
If you want to change a groundwater abstraction for which you have a permit under water law, you must apply to the responsible authority for a permit change.
If you want to extract groundwater in larger quantities, you need a water law permit.
If you would like to change a project for which you have a water law permit, you must apply to the responsible authority for a permit change.
The permit specifies the type and extent of use and is limited in time. It may be subject to conditions and ancillary provisions.
Which documents you need for your application varies depending on the type and scope of your project. In a preliminary discussion with the responsible water authority, you can clarify which documents are required in your case.
As a rule, you must provide all documents proving the change, such as
- Site plan with changes
- Explanatory report in case of significant changes,
- Information on planned facilities
- The responsible authority has a water law permit for the project.
- The groundwater and the public water supply are not endangered by your use.
- Your project does not fall under public use, for which no water law permit is required.
- You send your application for a change of permit with the required documents to the responsible authority.
- The competent authority
- checks the completeness of your application and documents and contacts you if any information or documents are missing,
- examines your application from a water management and water law perspective and, if necessary, involves other bodies.
- You receive
- a change notice for the permit or
- a rejection notice
- You will also receive a fee notice.
- You pay the fee.
The processing time depends in particular on the quality and scope of your application and the documents. You must expect a processing time of 4 weeks. In individual cases, processing may take longer or shorter.
There is no legal deadline. Apply for the change in permit well in advance of the planned change in the withdrawal.
- A water law permit is required for the extraction of groundwater in larger quantities.
- If a project for which a water law permit has been issued is to be changed, an application for a change in the permit must be submitted to the competent authority.
