Errichtung/ wesentliche Änderung von Anlagen im 20 m Streifen einer Hochwasserschutzanlage

If you have a justified reason to use the area of a flood protection facility up to 20 meters from its landward boundary for the construction or modification of a facility, you can apply for an exemption from the ban on the use of flood protection facilities under certain circumstances.

§ Section 76 (1) of the Bremen Water Protection Act states that facilities of any kind may not be erected or significantly altered within 20 meters of the landward boundary of flood protection facilities. Under certain conditions, the water authority of the Senator for the Environment, Construction and Transport may grant an exemption on application. The party responsible for maintenance will be consulted.

  • ground plan and sectional drawing

The water authority may grant an exemption from the prohibition upon request if

• the prohibition leads to an obviously unintended hardship in the individual case,
• the exemption is compatible with the interests of flood protection.

The attached application (see form) for an exemption under water law in accordance with §§ 74, 76 of the Bremen Water Act must be submitted to the water authority of the Senator for the Environment, Construction and Transport (see "Responsible body"). The following must also be submitted in triplicate

• General plan with identification of the property
• site plan
• Building description
• Floor plan and sectional drawing

If the use or necessary modification of the flood protection system is significantly impaired by the use or utilization, the exemption may be revoked.
