In order to be allowed to set up gaming devices that offer the possibility of winning, the suitability of the installation site must be determined.

Pursuant to Section 33c of the German Trade, Commerce and Industry Regulation Act (Gewerbeordnung), proof must be provided for each place of installation of gaming machines with the possibility of winning that it is suitable for this purpose. Such a confirmation of suitability by the locally competent authority is a prerequisite for the installation of gaming machines with the possibility of winning.

Pursuant to Section 1 of the Gaming Ordinance, gambling devices with the possibility of winning may only be set up on the premises of pubs and restaurants where drinks and food can be consumed on site, accommodation establishments, gaming arcades and similar establishments, as well as betting offices operated by licensed bookmakers. Before installing gaming devices with the possibility of winning, a confirmation of suitability must be applied for from the Senator for Economics, Labor and Europe, Department of Commercial Affairs for the installation site. The application can only be processed once it has been submitted to the authority in full. All details are checked to ensure that they are correct and eligible for approval under the law. This check can take up to 3 months.

All applicants are advised to contact the responsible office in advance. An appointment is also possible outside of regular opening hours by prior arrangement.
